These Terms of Service ("Terms") constitute a legally binding agreement between you and Open Day, LLC, a Delaware limited liability company ("Open Day," "we," "us," or "our"), governing your access to and use of our website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Important: Arbitration Notice. By using our platform, you agree—subject to limited exceptions—to resolve disputes with Open Day through binding individual arbitration rather than in court. Open Day is an online marketplace that connects buyers and sellers through live streaming and traditional e-commerce. We provide a space where you can list, discover, and transact for various Items. Please note that while we facilitate communication and payment processing (through our third-party payment processor, Stripe), we are not a party to your transactions. We do not own, create, or inspect the Items for sale; that responsibility rests solely with the Users.

Eligibility

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of Open Day after any changes constitutes acceptance of the new Terms.
